LICENSING TERMS AND CONDITIONS
Note: You are our most important customer. If you have a problem with a downloaded photograph, contact us and we will do our best to correct it. If you are looking for a particular bird, animal, plant or place and you don't see it here, contact us and we'll search our vast library to find it.
The Basics
You are buying a license to use photographs offered on this website royalty free. By downloading our photographs, you accept the terms of this agreement.
Every file downloaded from Wild South Florida comes with a standard license subject to rights and restrictions as described below.
All photographs are under copyright. You may download and use watermarked photos for test or sample layout use only. However, watermarked content cannot be used in any final or publicly available materials.
Rights
You may use photos in any way that is not restricted (see below). "Use" means to copy, reproduce, modify, edit, display, broadcast or publish. The rights granted to you by Wild South Florida are:
Perpetual — there is no expiration or end date to your right to use photos purchased and downloaded under this agreement.
Non-exclusive — you do not have exclusive rights to use photos. Wild South Florida may license the same photos to other customers. Exclusive use rights may be bought for an additional fee. (Contact us. We reserve the right to use these photos on our other websites.)
Worldwide. Photos may be used without regard to state or country.
Unlimited. You may use the content in an unlimited number of projects and in any media, including: in websites; blog posts; social media; interpretive signs, posters and pamphlets; advertisements; marketing campaigns; corporate presentations; newspapers; magazines; books; film and television productions; web and mobile applications; product packaging. Restrictions
You may not use photos in a pornographic, defamatory or any illegal manner, to promote violence or hatred.
Any photos marked for "Editorial Use Only” are intended to be used for journalistic purposes, discussion of current events or other human interest topics, in a blog, textbook, newspaper or magazine article. They may not be used for commercial purpose, including promotional, advertorial, endorsement, advertising, gambling/betting/gaming uses or merchandising.
Photographs may not be used in any way that allows others to download, extract, or redistribute them in a standalone file separate from the project or end use.
Photos may not be used (in whole or in part) as the distinctive feature of a trademark, design mark, tradename, business name, service mark, or logo.
You may not falsely claim to be the original creator of an end use that is made up largely of one of our photos. For instance, you cannot create a painting based solely on a licensed photo and claim that you are the author.
Who, besides me, can use licensed photos?
The rights granted to you are non-transferable and non-sublicensable, meaning that you cannot transfer or sublicense them to anyone else except:
If you are buying on behalf of your employer or a client, then your employer or client may use the content. Your employer or client becomes bound to the terms of this agreement.
You may allow subcontractors to use photos in any process related to your final project or end use. These subcontractors and distributors may not use the photos for any other purpose.
Intellectual property rights
All licensed photos remain the property of either Wild South Florida and/or the photographers who supply them. All rights not expressly granted in this agreement are reserved by Wild South Florida and the photographers.
You do not need to include a photo credit for commercial use, but for editorial purposes, you must include the following credit adjacent to the content or in visual production credits: “Wild South Florida/Artist's Name.”
Wild South Florida does not offer refunds or re-credits for downloaded files. However, if you do have a problem with a download, we will gladly do our best to correct them. Returns will be considered based on technical issues with the file at the sole discretion of Wild South Florida.
